Terms and Conditions of Sale
1. Commitment of Dahlströms Fine Art AB
Dahlströms Fine Art commits to acting as a commissioner for the sale of the items submitted by the seller under the terms specified below. Dahlströms Fine Art has the authority to sell the submitted items at the auction that, in their judgment, will yield the best result or for other suitable reasons.
2. Submission
The seller is responsible for possessing complete and unaltered ownership of the items they submit to Dahlströms Fine Art for sale. If the item is owned by a third party, the seller must prove their right to sell and receive payment for it. In cases of third-party ownership, this must be verified in writing. Despite this, Dahlströms Fine Art is not obliged to verify the seller's right to sell the item without specific reason. A written or digital sales agreement is established between Dahlströms Fine Art and the seller as soon as Dahlströms Fine Art has accepted to sell the item. Dahlströms Fine Art reserves the right to unilaterally withdraw from the sales assignment without compensation to the seller if doubts arise about the item's authenticity, ownership, or other essential details. The seller or the person submitting the item must inform Dahlströms Fine Art of any known defects and deficiencies. Withdrawal of the sales assignment must be made in writing. The seller does not have the right to withdraw the sales assignment without Dahlströms Fine Art's consent later than three days before the item is displayed to the public. Upon withdrawal, the seller shall compensate Dahlströms Fine Art for costs related to handling and valuation of the items, equivalent to the sales fees calculated on the starting price. Transport of items to and from Dahlströms Fine Art is at the seller's expense and risk.
3. Cataloging
Dahlströms Fine Art reserves the full right to determine the description and depiction of items on the internet. All photographs and images are owned by Dahlströms Fine Art and can be used without special compensation for purposes not related to the sale. The starting price is based on a market-adjusted valuation of the item before the auction. It is only an estimate and a guideline for the buyer, and the actual sales price may differ significantly from the starting price.
4. Sales Fees
For each auction item, a commission of 20% including VAT of the hammered amount and a fixed fee of 80 SEK including VAT for photo and insurance are charged upon sale.
5. Storage and Insurance
Dahlströms Fine Art insures submitted items against damage from receipt and covers incidents such as burglary, fire, water damage, theft, or breakage up to a maximum value equivalent to the starting price minus sales fees or the hammered price minus sales fees, unless another insurance value has been specifically agreed upon. We store submitted items securely and take responsibility for their protection. However, we cannot be held responsible for damage to painting glass and frames or for natural changes in living materials such as paper fading and cracks in wood or wear during display. Our liability for submitted items is limited according to these terms, and we do not undertake to compensate the seller for damages exceeding the insurance value specified for the submitted item.
6. Monitoring
Through monitoring, Dahlströms Fine Art ensures that items are not sold below an agreed acceptable price on behalf of the seller. The agreed acceptable price must not exceed the set starting price and must be approved by Dahlströms Fine Art. This acceptable price should be confirmed either in the sales agreement or in written form at a later date after agreement with Dahlströms Fine Art. If an item does not reach the monitoring price or is knocked down without any bids, the item returns to the seller. Dahlströms Fine Art has the right to sell an item below the monitoring price provided that the seller receives as much payment as if the sale had reached the acceptable price.
7. Accounting
After the auction, the seller receives a preliminary written report of the auction results.
8. Payment
Payment to the seller is made no later than thirty (30) days after the auction's conclusion, provided full payment has been received from the buyer and no claims, cancellations, or use of the statutory right of withdrawal have occurred. In sales to consumers, the buyer has a statutory right of withdrawal of fourteen (14) days from the receipt of the item. If the withdrawal period for the buyer has not expired at the time of the regular payment, the payment to the seller will be postponed to five (5) bank days after the withdrawal period's expiration, provided the buyer has not notified Dahlströms Fine Art within the withdrawal period of their wish to exercise their right of withdrawal. If the buyer has notified this but does not return the item within the statutory time for return, Dahlströms Fine Art has the right to demand that the buyer completes the purchase. In such cases, the payment to the seller is postponed to five (5) bank days after the return period's expiration (which means a maximum of twenty-eight (28) days, plus five (5) bank days, from the time the buyer is considered to have received the item).
9. Unsold Items
If an item does not sell and no other agreement has been made, Dahlströms Fine Art reserves the right to resell the item at auction again without prior notice. If the item has been at auction three times previously, Dahlströms Fine Art has the right to publish the item three more times. Items not to be resold must be collected no later than 7 days after the auction. If the item is not collected, Dahlströms Fine Art reserves the right to either donate the item to charity or resell it with a reduced monitoring price, even without the seller's written consent.
10. Liability for Errors
If Dahlströms Fine Art becomes liable to the seller for errors in sold items, Dahlströms Fine Art has the right to seek compensation from the seller equivalent to the compensation Dahlströms Fine Art may have paid to the buyer due to the error. The seller is aware of the general conditions that Dahlströms Fine Art applies to buyers at auctions. Dahlströms Fine Art does not guarantee that the services on the website are continuously available. Dahlströms Fine Art is not responsible for any inconveniences or economic consequences that affect customers due to the bidding function or other features not being available at all times.
11. Personal Data, Money Laundering, etc.
Personal data, such as name, address, personal number, phone number, and email address, provided in connection with Dahlströms Fine Art's services or otherwise within the framework of a contractual relationship with Dahlströms Fine Art, are used for administration and fulfillment of Dahlströms Fine Art's obligations related to auction activities, to provide good service, and to fulfill obligations under the law. Personal data may also be processed for market and customer analysis and statistics as well as for marketing purposes, such as targeted advertising, administrative messages, product offers, newsletters, etc.
12. Force Majeure
Dahlströms Fine Art shall not be liable for failure to fulfill a certain obligation under this agreement if the failure is due to circumstances of the following kind and the circumstance hinders or significantly complicates the timely fulfillment thereof. Such exempting circumstances may include acts of war, currency restrictions, lack of means of transport, fire, government actions, changed legislation, labor conflicts, general shortage of goods, restrictions in driving power, accidents, or similar conditions. If Dahlströms Fine Art's fulfillment of a certain obligation is delayed by more than three months due to exempting circumstances, the seller has the right to terminate the agreement in writing without compensation.
13. Dispute
Any disputes between Dahlströms Fine Art and sellers regarding the above-stipulated terms shall be resolved according to Swedish law and in Swedish court.
Effective Date
These general terms apply to sales assignments confirmed after May 20, 2024.
